'Modern History' views claim that in order for a trait X to have the proper function F, X must have been recently favored by natural selection for doing F (Griffiths 1992, 1993; Godfrey-Smith 1994). For many traits with prototypical proper functions, however, such recent selection may not have occurred, since traits may have been maintained owing to lack of variation or selection for other effects. I explore this flaw in Modern History accounts and offer an alternative etiological theory, which I (...) call the 'Continuing Usefulness' account. According to my view, a trait has the proper function F if and only if, first, the trait was favored by selection for doing F at some point (perhaps far in the past), and, secondly, the trait has recently contributed to survival and reproduction by doing F. This separates the requirement involving natural selection from the one involving the recent past, two issues that the Modern History account conflates. The clear separation allows a detailed analysis of the causal judgments and form of adaptationism that ground the etiological approach to function. (shrink)

The notion of time emerged from the observation of celestial phenomena and the construction of calendars. Its development towards ever higher precision went along with qualitative changes, and was shaped by cultural predisposition. With Einstein's theories of relativity at the lastest, special and general, the nature of time was defined in terms of the metric of a four-dimensional space-time which in turn depends on the distribution of matter. However, it should not be ignored that these theories are local in character (...) and that any projection onto the universe as a whole contains unchecked assumptions. This leaves room for a variety of models. This article promotes the picture of a directed time in a matter-filled space with tree structure, branches developing in the neighborhood of dense mass distributions and possibly ending in black holes. German Der Zeitbegriff der Physik hat sich aus Anfängen in der Himmelsbeobachtung und der Konstruktion von Kalendern nicht nur zu immer höherer Präzision entwickelt, sondern er hat mannigfache qualitative Veränderungen erfahren. Dabei hat es immer auch kulturell bedingte Alternativen gegeben. Spätestens mit Einsteins beiden Relativitätstheorien, der speziellen und der allgemeinen, wurde die Natur der Zeit durch die Metrik der vierdimensionalen Raumzeit definiert, die ihrerseits aufs Engste mit der Materieverteilung zusammenhängt. Es sollte aber nicht vergessen werden, dass diese Theorien einen lokalen Charakter haben und jede Projektion auf den Kosmos als Ganzes ungeprüfte Annahmen enthält. Das lässt Raum für unterschiedliche Modelle. Hier wird eine gerichtete Zeit mit Baumstruktur favorisiert, deren Zweige in je einem schwarzen Loch ihr Ende finden. (shrink)

I argue that ductal carcinoma in situ (DCIS), the tumor most commonly diagnosed by breast mammography, cannot be confidently classified as cancer, that is, as pathological. This is because there may not be dysfunction present in DCIS—as I argue based on its high prevalence and the small amount of risk it conveys—and thus DCIS may not count as a disease by dysfunction-requiring approaches, such as Boorse’s biostatistical theory and Wakefield’s harmful dysfunction account. Patients should decide about treatment for DCIS based (...) on the risks it poses and the risks and benefits of treatment, not on its disease status. (shrink)

Barley aleurone cells have long served as a model system for studying the regulation of gene expression in plants. In this review we survey what is known about hormone‐regulated gene expression in aleurone cells. We also describe the effects of heat stress on gene expression in this system, and speculate how the aleurone cell prioritizes its response between hormone‐induced and environment‐induced programs of gene expression.

This article discusses judicial recruitment in civil law countries. It introduces the emergence of comparative global studies. The United States was the first country to offer university courses on the judiciary outside of law schools. Significant empirical research has been carried out on the system of judicial recruitment since the latter half of the twentieth century and in recent years much of the work of empirically oriented judicial researchers has focused on reforming traditional ways of recruiting and appointing judges. In (...) countries with authoritarian regimes, empirical judicial studies focus on how judiciaries are developed to enforce the regime's policies. Research has shown variations among career judiciaries and their convergence with common law models of the judicial career. It is foreseen that the next wave of empirical research on judiciaries will show how differences in recruitment systems and judicial education influence judicial decision-making. (shrink)

There is nothing so difficult to understand as the obvious, because the assumptions underlying it are rarely examined or challenged. Technology has become just such an obvious facet of our existence at the start of the twenty-first century. Our daily lives are shaped and directed by technology; it dominates our work and our leisure, constructs our home and work and our means of traveling between them, in ways so obvious it remains, for the most part, unexamined.Technology has the Janus-like character (...) of being both benefactor and threat. Unfortunately, neither aspect of technology is well understood by most of the participants in our current global culture. Until we understand the nature of technology, however, we will not recognize the assumptions and choices inherent in the technology that, at the moment, holds as much peril as promise for our future. Without that critical understanding, we will accept as inescapable what is in fact open to choice. We may make poor choices without recognizing that we are even choosing, and we may miss the opportunities to choose wisely for ourselves and for future generations.To better understand technology, therefore, we need to unpack the obvious and examine technology more closely, both to identify some prevalent assumptions about it, and to provide the conceptual tools we need to make wise choices about the technology we develop and use.These twelve statements about the nature of technology are a starting point for such an examination, a framework for conversation among the choosers and users of technology. Peter Sedgwick explores the relation of a theology of justice to that of human identity in the context of the market economy, and engages with critics of capitalism and the market. He examines three aspects of the market economy: first, how does it shape personal identity, through consumption and the experience of paid employment in relation to the work ethic? Second, what impact does the global economy have on local cultures? Finally, as manufacturing changes out of all recognition through (...) the impact of technology and global competition, what is the effect in terms of poverty? Drawing on the response of the Catholic Church, both in the United States and in papal encyclicals, to the market economy from 1985–1991, Sedgwick argues that its involvement deserves to be better known. Moreover, he recommends that the Churches remain part of the debate in reforming and humanizing the market economy. (shrink)

The biochemical mechanism by which the phytochrome family of plant sensory photoreceptors transmit perceived informational light signals downstream to transduction pathway components is undetermined. The recent sequencing of the entire genome of the cyanobacterium Synechocystis, however, has revealed a protein that has an NH2‐terminal domain with striking sequence similarity to the photosensory NH2‐terminal domain of the phytochromes, and a COOH‐terminal domain strongly related to the transmitter histidine kinase module of bacterial two‐component sensors. The Synechocystis protein is capable of autocatalytic chromophore (...) ligation and exhibits photoreversible light‐absorption changes analogous to the phytochromes, indicating its capacity to function as an informational photoreceptor. Together with earlier observations that the COOH‐terminal domains of the plant phytochromes also have sequence similarity to the histidine kinases, these data suggest that the cyanobacteria utilize photoregulated histidine kinases as a sensory system and that the plant phytochromes may be evolutionary descendants of these photoreceptors.
